Federal Law/State Statute related to Equity

  1. Age Discrimination Act of 1975 - No person in the United States shall, on the basis of age, be excluded from participation, be denied the benefits of, or be subjected to discrimination, under any program or activity receiving Federal financial assistance. [[27]]
  2. American with Disabilities Act of 1990 - No covered entity shall discriminate against a qualified individual on the basis of disability in regard to job application procedures, the hiring,advancement, or discharge of employees, employee compensation,job training, and other terms,conditions, and privileges of employment. [[28]]
  3. Elementary and Secondary Education Act (No Child Left Behind) - Ensures that all children have a fair, equal, and significant opportunity to obtain a high-quality education and reach, at a minimum, proficiency on challenging State academic achievement standards and state academic assessments. [[29]]
  4. Florida Civil Rights Act of 1992 - Secured for all individuals within the state, freedom from discrimination because of race, color, religion, sex, national origin, handicap, or marital status and thereby to protect their interest in personal dignity, to make available to the state their full productive capacities, to secure the state against domestic strife and unrest, to preserve the public safety,health, and general welfare, and to promote the interests, rights, and privileges of individuals within the state.   5. Florida Educational Equity Act - Prohibits discrimination on the basis of race, ethnicity, national origin, gender, disability, or marital status against a student or an employee in the state system of public K-20 education program or activity, in any employment conditions or practices, conducted by a public educational institution that receives or benefits from federal or state financial assistance. [[31]]
  6. Genetic Information Nondiscrimination Act - Illegal to discriminate against employees or applicants because of genetic information. Prohibits the use of genetic information in making employment decisions, restricts employers, employment agencies, labor organizations and joint labor-management training and apprenticeship programs from requesting, requiring, or purchasing genetic information,and strictly limits the disclosure of genetic information.   7. Individuals with Disabilities Improvement Act of 2004 - Ensures that all children with disabilities have available to them a free appropriate public education that emphasizes special education and related services designed to meet their unique needs and prepare them for further education, employment, and independent living. [[33]]
  8. Rehabilitation Act of 1973 - Prohibits discrimination on the basis of disability in programs conducted by federal agencies, in programs receiving federal financial assistance, in federal employment, and in the employment practices of federal contractors.The standards for determining employment discrimination under the Rehabilitation Act are the same as those used in Title 1 of the Americans with Disabilities Act.   9. Section 504 Rehabilitation Act - No otherwise qualified individual with a disability shall, solely by reason of his or her disability, be excluded from the participation in, or be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.   10. Title VI of the Civil Rights Act of 1964 - Prohibits discrimination on the basis of face, color, and national origin in programs and activities receiving federal financial assistance. [[36]]
  11. Title VII of the Civil Rigths Act of 1964 - Prohibits employment discrimination based on race, color, religion, sex and national origin. [[37]]
  12. Title IX Education Amendments of 1972 - Protects people from discrimination based on sex, including sexual harassment, the failure to provide equal opportunity in athletics, and discrimination based on pregnancy in education programs and activities that receive federal assistance. [[38]]
